Deze COI Focus Algemene situatie biedt een overzicht van een brede waaier van relevante en actuele COI-bronnen over Albanië. Het gaat hierbij over COI-bronnen van andere lidstaten van de Europese Unie (EU), de European Asylum Support Office (EASO) en van het Amerikaanse ministerie van Buitenlandse Zaken als ook van de Hoge Commissaris van de Verenigde Naties voor de Vluchtelingen (United Nations High Commissioner for Refugees, UNHCR), van de Raad van Europa of van andere internationale organisaties (Freedom House, Amnesty International, Human Rights Watch, de Bertelsmann Stiftung, Reporters Without Borders). Ten slotte zijn ook een aantal Albanese bronnen opgenomen: het Albanian Helsinki Committee (AHC), de Dienst van de ombudsman, enz.

Ook de relevante informatie uit de zogenoemde Progress Reports van de Europese Commissie (EC) maakt deel uit van dit overzicht. In deze rapporten evalueert de EC de lokale implementering van het EU-uitbreidingsbeleid voor Albanië. Dit uitbreidingsbeleid is gebaseerd op vooropgestelde criteria waarvan sommige ook relevant zijn in dit COI-overzicht.

Sinds jaren volgt de Balkandesk van Cedoca de situatie in Albanië op de voet. In maart 2017 heeft Cedoca een COI-missie uitgevoerd waarbij zowel in de hoofdstad Tirana als in noordelijk Albanië (Shkodër en Fushe-Arrez) onderzoek verricht is naar het fenomeen bloedwraak en naar het fenomeen huiselijk geweld. Dit document is dan ook gebaseerd op informatie die verworven is via rechtstreekse contacten uit het contactennetwerk van Cedoca.

Dit document is een actualisering van een eerder overzicht van de situatie in Albanië, gepubliceerd op 27 juni 2018. Het is aangevuld met informatie uit de periode van augustus 2018 tot mei 2020. De beschikbare informatie staat niet alleen thematisch maar telkens ook chronologisch geordend zodat de evolutie van elk thema gedurende de voorbije vijf jaar zichtbaar wordt.

Policy

The policy implemented by the Commissioner General is based on a thorough analysis of accurate and up-to-date information on the general situation in the country of origin. This information is collated in a professional manner from various, objective sources, including the EASO, the UNHCR, relevant international human rights organisations, non-governmental organisations, professional literature and coverage in the media. When determining policy, the Commissioner General does not only examine the COI Focuses written by Cedoca and published on this website, as these deal with just one aspect of the general situation in the country of origin. The fact that a COI Focus could be out-of-date does not mean that the policy that is being implemented by the Commissioner General is no longer up-to-date.

When assessing an application for asylum, the Commissioner General not only considers the actual situation in the country of origin at the moment of decision-making, he also takes into account the individual situation and personal circumstances of the applicant for international protection. Every asylum application is examined individually. An applicant must comprehensively demonstrate that he has a well-founded fear of persecution or that there is a clear personal risk of serious harm. He cannot, therefore, simply refer back to the general conditions in his country, but must also present concrete, credible and personal facts.
